Commercial Appliance Ltd offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. 

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. 

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Section 1 - ONLINE STORE TERMS 
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site. 
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). 
You must not transmit any worms or viruses or any code of a destructive nature. 
A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate. 
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. 
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. 

Section 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION 
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. 

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In no case shall Commercial Appliance Ltd, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Commercial Appliance Ltd and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party. 

Section 15 - SEVERABILITY 
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions. 

Section 16 - TERMINATION 
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. 
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. 
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof). 

Section 17 - ENTIRE AGREEMENT 
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. 
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). 
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of United Kingdom.

Terms & Conditions of Sale
Commercial Appliance Ltd. is a supplier of commercial catering, laundry and refrigeration equipment and services to commercial customers and as such every sale is considered a business to business (B2B) contract. If you are not a commercial customer, please note that you will not be covered by the Distance Selling Regulations (DSR’s).

Section 1. Goods being Sold
1.1 Special offers are subject to stock availability and are subject to change without prior notice. Please note there may be a delay in updating stock levels of products so please contact us if you have any questions prior to ordering at 0800 158 3668 or sales@commercialappliance.co.uk.

1.2 All product images are for illustrative purposes and though we always aim to ensure they are accurate, the design may differ from the final delivered product. Variations may arise due to the lighting, position and equipment used to take the photograph of the product. 

1.3 Goods ordered in a specific colour, pattern or design are sold subject to stock availability. Commercial Appliance Ltd reserves the right to substitute goods with newer items or items of comparable or better quality, alternative colour, pattern or design with customer approval.

1.4 Where not specified, a price for equipment installation can be quoted subject to product and customer location.

1.5 Customers placing an order for age-restricted goods such as knives, solvents and cream whippers confirm that they are 18 years of age and that delivery will be accepted by a person over 18 years of age.

Section 2. Pricing and Payment
2.1 All prices listed are subject to the addition of VAT at the standard applicable rate. For UK customers, this is 20%.

2.2 Prices are correct at the time of listing and may be subject to change without prior notice.

2.3 Occasionally an error may cause product price/description to be incorrect, in which case Commercial Appliance Ltd shall be under no obligation to honour the incorrect price.

Section 3. Delivery
3.1 Delivery is generally restricted to the United Kingdom though orders outside the UK can be fulfilled upon special request.

3.2 All orders under £100.00 will incur a £7.50 carriage charge unless specified otherwise such as a discount code or on the product page.

3.3 Expected delivery time frames are shown on product pages, but may be subject to change due to stock availability or if any additional security checks are necessary.

3.4 The Customer is responsible for ensuring that all items will fit onto or within the premises. You (the Customer) are advised to check all entry door dimensions to ensure the product will fit onto or within the site. Any charges caused by an aborted delivery due to this will be passed onto the Customer.

3.5 Delivery as standard is a kerb side delivery to a ground floor site. In most cases this will be between the hours of 7.30am and 6.30pm but the courier may call you outside of these hours. This does NOT include unpacking and positioning - which must be done by the customer. Please note: In this instance drivers will be unable to assist with the unpacking process due to liability insurance regulation.

3.6 Where applicable or available, an Unpack and Position service can be purchased as per the individual courier rate. This optional service is available at the discretion of the courier service and/or manufacturer shipping service and will incur further charges to you (the Customer) and must be purchased at the point of order.

3.7 Where applicable or available, an engineer fitting installation service can be purchased prior to delivery. This optional service is available at our discretion, and is subject to location and time limitations. Please note: This service may be undertaken by third party engineers on behalf of Commercial Appliance Ltd. In the instance that you (the Customer) opts for installation, larger machines, our engineers will require positioning and/or unpacking assistance – which must be provided at site by you (the Customer).

3.8 Any refused delivery charges either directly from Commercial Appliance Ltd or third party suppliers will be passed onto the Customer where appropriate.

Section 4. Warranties and Returns
4.1 All warranties provided with equipment are operated and controlled by the manufacturer or master UK distributor, not Commercial Appliance Ltd. Responsibility for these warranties is held with the manufacturer or master UK distributor, and is only applicable to mainland UK. Please note that certain perishable items will not be covered under warranty such as bulbs, door seals and elements. If you are unsure at any point what is covered and what is not covered by warranty please contact us at 0800 158 3668 or sales@commercialappliance.co.uk.

4.2 Any products incorrectly ordered by the customer or goods that a Customer wishes to return/cancel will incur an industry standard restocking/cancellation charge. This constitutes a minimum of 5% of the original order value to cover card handling costs and all associated administration costs, however, this figure could be higher subject to the status of the order and the goods themselves. Goods can only be returned if unused and in the original packaging. If any goods are received in error this must be reported to us within 48 hours to allow us to deal with this effectively. Any issues reported after this time will not be able to be corrected and may be liable for extra charges.

4.3 Commercial Appliance Ltd are suppliers of commercial equipment and services to commercial customers and all sales are considered a business to business contract. Therefore we are not obligated to offer refunds or accept returns even if items are unused. If we chose to do so this will be at the discretion of Commercial Appliance Ltd. In this instance we will apply and charge a restock fee that we deem reasonable.

4.4 Notification of any goods that need to be returned or any damages must be reported within the first 24 hours after delivery. Damaged items that were not signed for as damaged will not be eligible for return. Please check all deliveries thoroughly before signing for them to make sure all products are satisfactory before accepting delivery.

4.5 Any special order items cannot be cancelled or returned once an order is placed. All stainless steel fabricated items are made to order and are therefore non-returnable.

4.6 All items carry a minimum of one-year parts only warranty unless otherwise stated, this warranty where applicable is the manufacturer’s warranty.

4.7 All commercial gas appliances must be installed by a qualified Gas Safe registered engineer. Failure to do so will void product warranty.

Section 5. Termination
5.1 Commercial Appliance Ltd reserves the right to cancel or suspend any order where payment has not been received or in which payment has failed subject to credit checks or otherwise.

5.2 Commercial Appliance Ltd reserves the right to suspend or terminate performance of this Agreement where delivery or supply of the Goods and/or performance of this Agreement is affect by reasons out of Commercial Appliance Ltd’s reasonable control such as force majeure, act of God, adverse weather and government intervention, sanction or legislation.

5.3 Commercial Appliance Ltd reserves the right to cancel any Order where it is reasonably suspected that the Customer is not legally permitted to purchase any Goods specified in the Order (such as solvents).

5.4 Commercial Appliance Ltd reserves the right, by notice to the Customers, to cancel or suspend any Order where payment has not been received in accordance with Clause 2 of this Agreement.

Section 6. Liability
6.1 Commercial Appliance Ltd cannot be held responsible for any costs/damage or loss of earnings due to any equipment being supplied faulty/damaged/developing a fault or deliveries failing/being delayed.

6.2 It is the responsibility of the Customer to be aware of all current legislation regarding catering equipment and its application/installation, Commercial Appliance Ltd cannot be held responsible for any issues/costs that arise from non-awareness. This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from commercialappliance.co.uk (the “Site”). 

Section 1. Personal information we collect 
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers, Paypal user ID, Paypal email address and associated billing information, email address, and phone number. We refer to this information as “Order Information”. 

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

We use the Order Information that we collect generally to fulfil any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

- Screen our orders for potential risk or fraud; and 
- When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services. 

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

Delivery / Shipping

Section 1. Delivery charges
1.1 Any orders over £100.00 (not including VAT) will be delivered free of charge. Orders under this value will incur a carriage charge of £7.50 unless stated otherwise on the product page or if advertised elsewhere on comercialappliance.co.uk.

1.2 Free delivery, or the £7.50 delivery charge is only applicable to countries within the United Kingdom including England, Scotland, Wales & Northern Ireland. This includes surrounding channel islands.

Section 2. Delivery times
2.1 As standard, deliveries are carried out between 9 am to 6 pm Monday - Friday. However in the event of a late delivery, the customer will be informed in advance.

2.2 Delivery lead times will vary dependent upon the product and manufacturer, with further details being found on individual product pages regarding typical delivery time frames or availability.

2.3 All delivery times quoted are based on orders being placed before 12:00 pm Monday-Friday. Orders placed after 12:00pm will be processed on the following working day.

2.4 Delivery times stated on the product page are not a guarantee and are subject to change depending on circumstances such as supplier stock levels and the customer's location. Section 3. Delivery restrictions
3.1 Prior to dispatch, we must be made aware of any restrictions that may affect the delivery in any way, such as weight limits, access limitations or pedestrianised zones.

3.3 This also includes any physical obstacles such as sharp bends, narrow roads, low bridges or weight restricted bridges prior to delivery at 0800 158 3668 or at sales@commercialappliance.co.uk. This allows for any alternative delivery options to be arranged and ensure that you (the Customer) receive items on time.

3.4 Failure to do so may cause the delivery to be aborted and additional charges may be incurred.

Section 4. Large Items
4.1 Delivery as standard for all orders is to the kerb side at a ground floor level.

4.2 Larger items may be delivered on a pallet or in a crate and will need to be moved on to your site/premises by yourself – an unpack and position service may be available at an extra cost, please contact us prior to purchase at 0800 158 3668 or at sales@commercialappliance.co.uk.

Section 6. Refusal of goods
6.1 Goods must be checked upon receipt and before you sign the delivery note.

6.2 Any goods not checked and signed for may not be able to be claimed for, should any issues arise due to damage.

6.3 Any failed delivery charges from suppliers will be passed onto the customer where appropriate.
Warranty Terms & Conditions
If you encounter a fault or error with your product, we recommend contacting our team at sales@commercialappliance.co.uk where we can help you troubleshoot your issue or get in contact with the manufacturer on your behalf to solve the issue. We strongly advise you to try and exercise all troubleshooting possibilities before escalating your issue to a warranty claim.

Please note that certain consumable items will not be covered under warranty such as bulbs, door seals and elements. To identify which products have warranty or which products are not covered, please contact us at 0800 158 3668 or at sales@commercialappliance.co.uk where we can further assist you.

Section 1. Faulty goods
1.1 If you discover an issue with your product please contact Commercial Appliance Ltd at 0800 158 3668 or at sales@commercialappliance.co.uk as soon as you become aware of this fault or defect as Commercial Appliance Ltd will not assume any responsibility for the fault or defect if notified after the expiry of the warranty period. This includes faults or defects that occurred within the period itself.

1.2 Commercial Appliance Ltd warranty policy listed in our terms, the product page, the order confirmation email and the invoice of the product will override any warranty specified by the product manufacturer which could be found on the manufacturer's website or brochure. 

1.3 Commercial Appliance Ltd hold the right to take payment upfront prior to a warranty claim being escalated. However, this payment will be refunded if the reason for fault is regarded to be within the warranty terms.

1.4 Exclusions from warranty include but are not limited to any incorrect installation that has been attempted by an individual who is not employed by Commercial Appliance Ltd, wear and tear of the product from continuous usage, any accidental damage caused to the product, using the product in an improper way or failure to properly maintain the product which would lead to faults. All warranty claims are subject to assessment to determine if your product falls is covered by warranty.

Section 2. Liability
2.1 Commercial Appliance Ltd is not liable for any 

(a) loss of profits
(b) business interruption 
(c) sales issues 

that could occur as a direct or indirect result due to a faulty or defective product

2.2 The consumer agrees that Commercial Appliance Ltd is not liable for any of the points stated above.

2.3 For gas products, failure to use a gas certified engineer for the installation of products requiring a connection to gas or improper use of gas equipment (such as lack of appropriate ventilation) will void all warranty relating to the product with immediate effect.

2.4 Commercial Appliance Ltd has a callout charge which is incurred by the consumer on any given occasion where any engineer is called out to the location of the consumer.

Section 3. Parts Only Warranty
3.1 Parts Only warranty allows Commercial Appliance Ltd to supply the parts to the consumer (if the reason for product defection/fault is covered within the warranty) free of charge to which can then be installed by any engineer chosen by the consumer at the consumer's own cost.

3.2 Commercial Appliance Ltd will not be held liable for any negligence or improper installation of parts by the engineer or individuals chosen to attempt to fix the product or install the supplied parts.

3.3 Following installation of the parts, the report made by the engineer must be forwarded to Commercial Appliance Ltd. This report will undergo assessment to ensure the consumer falls within the warranty terms stated by Commercial Appliance Ltd.

3.4 Following investigation, the required part will then be supplied to the consumer. If any charge was incurred by the consumer in reference to 1.4, this will be fully refunded to the consumer.

3.5 If requested, defective or broken parts must be sent back to Commercial Appliance Ltd. Failure to do so will result in the full cost including carriage of the replacement parts being incurred by the consumer.

Section 4. Parts and Labour Warranty
4.1 A Parts and Labour Warranty covers the cost of both the part and labour required to repair any fault covered by the specific product warranty.

4.2 Labour warranty only applies to Northern Ireland customers. Product's delivered to other countries are not subject to labour warranty and will maintain parts warranty as specified on the product page.

4.3 Callout charges are not covered by warranty, only the hourly rate of labour is covered. 4.4 If the fault is discovered to not be covered by our warranty policy, the consumer will be required to pay upfront the cost of repair and the parts required.

Section 5. Return to Base Warranty
5.1 If parts/small or portable appliances are to be returned to the manufacturer to be repaired, the cost of carriage will be the consumer's responsibility unless stated otherwise by the manufacturer.

5.2 The consumer will also be liable for any return carriage costs in-order to receive their fixed part/small or portable appliance.

5.4 Any damage or losses that occur during transit will be the responsibility of the consumer and not covered by Commercial Appliance Ltd warranty policy.



Before a warranty claim can be fulfilled, the consumer must fill out a warranty claim form supplied by Commercial Appliance Ltd.

All labour warranties are only applicable for Northern Ireland and any other sites outside of this will be limited to a parts only warranty as stated on the product page.
Returns and Cancellations
As a commercial appliance equipment supplier to the trade only, all returns are subject to authorisation by Commercial Appliance Ltd and are potentially subject to a re-stocking fee of up to 20%. The contract must be cancelled by the consumer within 14 days of receipt of the product being delivered. To be eligible for a return, your item must be in the same condition that you received it, unused and in its original packaging. You’ll also need the receipt or proof of purchase.

If your return is accepted, we’ll send you a return shipping label, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted. 

Section 1. Refunds 
1.1 We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method. Please remember it can take some time for your bank or credit card company to process and post the refund too.

Section 2. Cancellations
2.1 Customers have the right to cancel their order and this should be without issue as-long as the item(s) within the order have not been dispatched. If an item has been dispatched there may be a cancellation fee to cover relevant carriage fees. This fee will be the amount required to re-ship the product back to Commercial Appliance Ltd and cover all associated handling/carriage costs.


Before signing for your product, ensure it has no signs of damage and is your required product or you may make yourself ineligible for any damage claims for the product. It is the customers duty to check the product for any defects/damages before signing, not after.
